Allergan inks $600M off-label settlement

Pharma marketing got another black eye yesterday when the Department of Justice announced a $600 million settlement with Allergan. The drugmaker agreed to plead guilty to a misdemeanor and pay a $375 million fine and $225 million in civil penalties, all for pushing Botox for off-label uses such as headache, pain and cerebral palsy treatment.

It's far from the biggest off-label marketing settlement we've seen; Pfizer owns that crown with its $2.3 billion deal to resolve charges that it mismarketed the now-withdrawn pain killer Bextra and several other drugs. Eli Lilly's Zyprexa settlement, at $1.41 billion, also outranks the Allergan deal. But the Botox settlement beats out AstraZeneca's $520 million resolution to Seroquel mismarketing claims.

Merck's Cladribine Tablets for Multiple Sclerosis Approved in Australia

Merck KGaA announced today that the Australian Therapeutic Goods Administration (TGA) has approved Cladribine Tablets for the treatment of relapsing-remitting multiple sclerosis (MS). Cladribine Tablets will be registered in Australia under the trade name Movectro®.

"Approval of Cladribine Tablets in Australia is another step forward in our commitment to fight the devastating disease of multiple sclerosis by providing new therapeutic options meeting unmet needs," said Elmar Schnee, Member of the Executive Board and Head of the Merck Serono division.

Boehringer Ingelheim inaugurates the Shanghai "Center of Competence"

Boehringer Ingelheim celebrated the inauguration of its new "Center of Competence" (CoC) in Shanghai. As part of the company's EUR 100 million expansion project in China, the CoC entails an investment of EUR 10 million and will specialise in optimising active pharmaceutical ingredients (APIs) and chemical intermediates procured in China. So far, more than 20 highly-qualified organic and analytical chemists have been recruited for the CoC.

"This reinforces our company's determination and commitment to continue investing in China," said Prof. Wolfram Carius, Member of the Board of Managing Directors of Boehringer Ingelheim and responsible for the Board Division Human Resources and Operations. "We attach great importance to the exchange with our Chinese partners. We have a long-term commitment to this market and we are driving innovation in the country's pharmaceutical industry."

No Link Between Vaccines & Autism: Federal Court

Yet another court decision has thrown cold water on the theory that childhood vaccines are linked to autism. The US Court of Appeals for the Federal Circuit has upheld lower court decisions that rejected such a connection in a lawsuit that was the first in a series of several test cases heard by special masters for the US Court of Federal Claims, The Legal Times writes.

Three years ago, the claims court chose several lawsuits to test various theories that were floated in about 5,000 cases alleging a link to autism and filed under the National Childhood Vaccine Injury Act of 1986. The case at hand involved Michelle Cedillo, who was born in August 1994, vaccined with the MMR vaccine in December 1995 and, subsequently, experienced various reactions before being diagnosed with autism in July 1997. Her parents claimed thimerosal damaged her immune system.

Connecticut AG Supoenas Rite Aid Over Price Hikes

Connecticut Attorney General Richard Blumenthal claims Rite Aid pulled a fast one on consumers when it raised some prices, but then turned around blamed the state. And so he has issued a subpoena seeking information about how Rite Aid decided to charge what it does on numerous meds.

To be specific, a new state law requires pharmacies to provide the same discounts to Medicaid and other state programs that are offered to consumers. However, the AG charges Rite Aid instead simply increased prices and made other changes to its Rx Savings discount drug program in the state. And then the pharmacy chain posted signs blaming its higher prices and program changes on the new law.
